  • Same-Sex Weddings to Go Forward in California – Probably

    The California Supreme Court has refused to stay its May 15 decision to lift the ban on same-sex marriages in the state and the ruling will become final on June 16 at 5 pm according to a report by Law.com.  The high court has remanded the case to the 1st District Court of Appeals and the appellate court is expected to order the original trial court in San Francisco to issue a writ directing county clerks to begin issuing marriage licenses to gay couples who wish to get married.  Because this process could take a few days, same-sex couples may want to wait to tie the knot until the trial court issues its final ruling to avoid legal ambiguity about their marital status.

    The Liberty Counsel, a legal group representing social conservatives, plans to ask the 1st District Court of Appeal to stay its own order when it is received from the state Supreme Court.  The group feels that there is still hope to get a majority vote to create a stay because the 1st District panel originally upheld the ban on gay marriages.

    Of course, as we’ve seen elsewhere across the country, gay marriage is truly equal to heterosexual marriage – in that a number of them end up in divorce. However, because of ambiguities in some state laws, some gay couples looking to call it quits are having trouble ending their marriages in their home states.
